1) This agreement made between Dickerage Road Allotment Association (the ‘Association’) and ……………………………………………(the ‘Tenant’).
2) The Association agrees to let, and the Tenant agrees to hire
from (date)………………………..
allotment number: ……….……… at Dickerage Road Allotments (the ‘Allotment Site’)
at the annual rent of…..………….(to be reviewed annually) or pro-rata in proportion for any less period than a year over which the Tenancy may extend.
3) The Tenancy is subject to the Dickerage Road Allotment Association Rules made from time to time by the Association, to any conditions imposed by the Royal Borough of Kingston upon Thames and to all relevant national legislation on Allotments.
In any dispute over the interpretation of the Association’s rules, the decision of the Association’s Committee shall be final.
4) The Tenant agrees with the Association :-
a) To pay rent annually, within six weeks of the date of invoice (invoices will normally be issued in October for the subsequent year’s rent).
b) To maintain the allotment in a good state of cultivation (as defined in the Association’s rules) and clear from rubbish.
c) To use the allotment for private, non-commercial cultivation of vegetables and fruit only.
d) To use the allotment responsibly and not to annoy the tenants of adjoining allotments or the residents of nearby houses.
e) To gain access to the allotment site by the authorised means only.
f) To keep the paths, adjacent to the allotment, free of any obstruction.
g) To ensure that the number of the allotment is always clearly indicated.
h) Not to erect any fence, shed or other structure (other than those already on the allotment site at 31.12.2008) which exceeds the size or height specified by the Association’s rules.
i) Not to keep any livestock or insects on the allotment, and to keep any dogs tethered.
j) Not to erect or display any advertisement.
k) Not to assign sub-let or part with the possession of the allotment or any part of it.
l) Not to use barbed wire, or any other dangerous materials, anywhere on the allotment site.
m) Not to cut or prune any trees growing on the allotment or to remove from the allotment site any turf or soil.
n) Not to store any explosives, large quantities of inflammable material / liquids or any other noxious substances.
o) Not to alter any part of any water, electrical or gas installations on the allotment site.
p) To observe or perform any other conditions which the Association may from time to time approve for preserving the allotment site from deterioration
5) The Tenancy hereby created may be terminated:-
a) By the Association if the rent is in arrears for six weeks or more.
b) By the Association, after four weeks notice in writing, if the Tenant does not comply with any part of this agreement, in which case the Association will not be required to make any payment or refund whatsoever to the Tenant.
c) Upon the death of the Tenant.
d) By the Tenant, at any time, in which case the Association will not be required to make any payment or refund whatsoever to the tenant.
6) The Association will be entitled to recover compensation from the Tenant for any deterioration of the land on the termination of the Tenancy if the Tenant has failed to keep the allotment in a good state of cultivation and free of rubbish.
7) Any notice or permission that may be given under this agreement will be in writing and:
a) if given by the Association will be signed by an officer of the Association;.
b) if given by the Tenant will be signed by the Tenant and delivered to the Secretary of the Association.
8) Any notice may be served on the Tenant either personally or by leaving it at the Tenant's last known place of abode, or by registered letter addressed there, or by fixing the same in some conspicuous manner on the allotment.
