What the certificate does cover:

  • ✔️ Tree planting

  • ✔️ Play areas

What the certificate does NOT cover:

  • ❌ Public Open Space (POS)

  • ❌ SuDS / drainage systems

  • ❌ Allotment land

  • ❌ Any other Section 106 obligations

Why this matters

The legally required S106 steps have not been completed. This means:

  • The POS cannot be transferred

  • Residents cannot be charged

  • Developers remain responsible

Ombudsman Investigation Underway

SBC cannot provide the evidence behind the certificate. The Local Government Ombudsman is reviewing the missing records.

Our Position

Residents must not inherit land or drainage systems that:

  • Have not been inspected

  • Have not been certified

  • Have no supporting evidence

  • May contain defects or long‑term liabilities
